Privacy Statement

The NSW Institute of Teachers is an independent statutory authority established by the Institute of Teachers Act (2004) to advise the government on professional standards for the teaching profession and to oversight a school based system of accreditation.

The functions of the Institute are set out in section 7 of the Act:

(1)    The Institute has the functions conferred or imposed on it by or under this or any other Act.
(2)     The functions of the Institute include the following:
        (a)     to provide advice to the Minister on the development, content and application of the professional teaching standards,
        (b)     to provide advice to the Minister on any of the Minister’s other functions under this Act (including the function of approving persons or bodies as teacher accreditation authorities in relation to non-government schools or the suspension or revocation of any such approval),
        (c)     to advise and assist teacher accreditation authorities in accrediting persons under this Act,
        (d)     to monitor the accreditation process across all schools,
        (e)     to ensure that the professional teaching standards are applied fairly and consistently.

(3)     Without limiting subsection (2), the functions of the Institute include providing advice to the Minister on:
        (a)     the approval by the Minister of initial and continuing teacher education courses or programs that are relevant for the purposes of accreditation under this Act, and
        (b)     the approval by the Minister of persons or bodies who may provide professional development in accordance with the requirements of the professional teaching standards.

It is a requirement of the Act that all New and Transition scheme teachers be accredited in order to be employed in a school.

Purpose of this policy

The purpose of this Privacy Policy is to tell you what kind of information we may gather to undertake our functions, how we may collect that information, how we may use that information and whether we disclose it to anyone. 

Why do we collect information?

The Institute of Teachers is required by the legislation to maintain either in written or electronic form a roll of teachers consisting of two parts:

  1. an electoral list of teachers (as set out in Part 3 of the Act) eligible to vote in the election of members of the Quality Teaching Council
  2. An accreditation list containing details of teachers accredited under the Act.

The Institute collects this information to fulfil its functions as set out in Section 7 of the Institute of Teachers Act 2004.

What information do we collect?

The information collected by the Institute is set out in Section 4 and Section 5 of the Institute’s Regulation. The Regulation is available on the Institute’s website (www.nswteachers.nsw.edu.au)

The Institute also obtains information from teacher employers including name, date of birth, address, school sector and position of employed teachers in order to develop and maintain the Institute’s electoral roll.

How we collect your personal information

The Institute collects most information either directly from you, from your employer or from your Teacher Accreditation Authority for example when you fill in an application form for accreditation or when you provide information to the Institute in order to pay the annual accreditation fee.

The Institute also receives personal information about teachers - such as name, postal address and date of birth - from teacher employers in relation to their placement on the Institute’s electoral roll. Teachers also provide this information voluntarily in response to advertisements.

How does the Institute use the information collected?

The Institute will use the personal information that it collects to fulfil its functions under the Act.

The Institute will use the information to:

·          monitor applications for accreditation
·          create a database of all accredited teachers in NSW
·          record employment and professional development histories
·          provide an electoral roll for the election of the Quality Teaching Council
·          communicate with accredited teachers regarding accreditation requirements including the payment of fees
·          process payments of the annual accreditation fee
·          provide accredited teachers with updates regarding the work of the Institute
·          provide membership services such as an e-newsletter
·          analyse general trends relating to teachers and teaching
·          advise Teacher Accreditation Authorities, employers of teachers and school principals of individual teachers compliance with accreditation requirements.

How does the Institute handle sensitive information?

Sensitive information refers to information relating to a person’s ethnicity, language background, possible criminal record, as well as personal details to enable payment of the annual accreditation fee.

Sensitive information will be used and disclosed only for the purpose for which it was provided, such as for the payment of the annual fee.

Sensitive information will be managed in accordance with the Privacy and Personal Information Protection Act and the Institute’s Information and Records Management Policy.

Some sensitive information (for example, criminal records in relation to child protection matters) may be disclosed to relevant authorities in the public interest.

Security of personal information

The staff of the Institute understands and respects the need to maintain the confidentiality of teachers’ personal information in accordance with the Privacy and Personal Information Protection Act and the Institute’s Code of Conduct.

Your information may be securely stored in hardcopy documents, as electronic data or in our software systems. The Institute has processes in place to protect the personal and sensitive information held by the Institute from misuse, loss, unauthorised access, modification or disclosure including the locked storage of paper records and electronic security measures such as password access to computerised records.

The Institute uses secure site certificates (SSL) to encrypt any web communications with the Institute web site and to ensure total privacy. Passwords used to access Institute sites are also encrypted.

Accessing and correcting personal information

The Institute relies on teachers and their employers to ensure that any information provided to the Institute is complete and up-to-date. Accurate information allows the Institute to provide the best possible service.

Accredited teachers are able to write to the Institute or to log in to the Institute’s database to update their personal information. This excludes information relating to qualifications which need to be sighted and verified by the Institute.

Accredited teachers will also have the opportunity to update their information by completing a form which accompanies the annual fee invoice.

Cookies

Cookies may be used by the Institute to allow users to customise their view of the NSW Institute of Teachers website. The Institute will not use cookies to track users in any manner. The blocking of any cookies by users will not impact on their use of the Institute’s web site.

Disclosure

There will be occasions where it will be necessary for the Institute to disclose your personal information to third parties.

The Institute has broad powers under the Act to receive and exchange information with a Teacher Accreditation Authority or any person or body responsible for teacher employment in NSW.

The Institute may be required by law to disclose the information, or the Institute may be required to disclose your personal information to third parties to provide the service you have requested.

For example:  

·          if you wish to participate in the election of the Institute’s Quality Teaching Council, your information will be forwarded to the NSW State Electoral Commission, or

·          if you have provided the Institute with information in order to pay an annual accreditation fee, this information will be forwarded to the Institute’s bank in order to process the payment.

·          school principals will have access to information about a specific teacher’s accreditation status and accreditation level. Access to this information is required to ensure that schools are not in breach of section 29 of the Institute of Teachers Act.

No sale of personal information

Under no circumstances will the NSW Institute of Teachers exchange, sell or receive payment for licensing or disclosing your personal information for commercial or other purposes.
